Last week, the 11th Circuit Court of Appeals ruled 2-1 against my friend Jimmy Davis Jr.’s appeal to overturn his death sentence for the 1993 murder of an oil station attendant named Johnny Hazel, upholding Davis’ death sentence.
I just received the full ruling a couple days ago and am partway through it. I’ll try to provide updates and information as I’m reading it.
I’m told the dissent is quite vigorous, which could be important. Davis’ lawyers will likely try to convince the full court to adopt the dissent as the official opinion. If they lose, his case will next go to the Supreme Court, which is of course the end of the road.
For background on the story, see the series I wrote about the Jimmy Davis, Jr. case here, here, and here, which I’ll most likely add to in the coming weeks and months.
